You can't compare a Depo shot with oral contraception (or aspirin!) Further, the first Depo is NOT effective immediately- you should use a condom for 7 days. You can also get pregnant on any type of birth control and legally this is a completely moot point for any medical practicioner. She was simply giving you some solid advice and has nothing to fear from a malpractice lawyer.
