I don't see anything illegal about it. The OB is just trying to psych up her patients. She's not PROMISING that head-pelvis disproportion won't happen, but she's just making the presumption that the woman will be able to push out her baby. And in 98% of her patients, that is the case.

Now, if she were putting lives in jeapordy to maintain her 98% record, that would be a malpractice suit waiting to happen. But that doesn't seem to be what you are asking.
