Where these statutes exist, they are usually in a 3-5 year time frame. However, the larger issue is the size of the jury awards, which have skyrocketed, when cases do go to trial. These awards are made up of economic and non-economic (pain and suffering) dollar amounts. Depending on the seriousness of the injury, the claimant could require lifetime medical care. The shortage of OBGYN's has not occurred in all states. A few states have a serious problem, and some other states are heading in that direction. Insurance premiums have shot up, especially for OB's, mainly because of high jury awards. To a lesser extent, lower investment income for insuers and higher reinsurance costs for insurers have played a role.
