My remarks were not in regard to her mother being in the room, but rather that the ER doctor had printed out her entire electonic medical record from other physicians, which was not relevant to the stomach ache she developed while eating in a restaurant. I think this case would be a somewhat gray area under HIPAA, and in her case it doesn't matter because the event happened before the law went into effect. As I said before , the best person to speak with would be the compliance officer at the hospital where she was treated.
