Martin - everything you say is of course correct, but as I am sure you know, we have a system in this Country that involves people of ill will. Certainly the patient's attorney, if the patient chooses to sue for something, is not going to try to be fair or reasonable. And we do have predatory patients.

Probably the results of other lawsuits play a role in determining what types of situations we are advised to get a consent for. If an insurance company or the Joint Commission on Accreditation of Healthcare Organizations (JCAHO) has information about suits brought because of certain situations, like prenatal ultrasound, they are going to advise others to do things to protect themselves from similar situations.

If you explain everything carefully to the patient, as has been discussed in this thread, but the patient decides to sue, the patient will not be inclined to recall that conversation, and if she does, her attorney will be sure to tell her to forget it. If you have a piece of paper, it might help. Of course she can still say she did not understand, you did not let her read it, etc etc, but I think it would help.

In any event, it is not a good idea to argue with the JCAHO surveyors. They said it looks like we passed with a score of 96 out of a possible 100, but our official announcement will come from them in about one month. We are pretty tickled!
