I was a witness for the plaintiff in a case in which a biophysical profile was ordered for mild toxemia, no fetal movement and nonreactive NST. Three days later a baby was born with severe and permanent global brain damage that was pretty clearly related to a profound and ongoing fetomaternal hemorrhage. All the images, paperwork and official report indicate that a general OB sonogram and not a BPP was performed that night.

The radiologist group settled independently. The hospital and physicians took the case to the wall, claiming -among other things- that a BPP was actually done and was reassuring. The jury did not buy it and neither did I. A keepsake tape showing ! a normal BPP would definitely have changed my opinion, and probably that of the jury as well.

The jury assessed 80% of the $17 Million damages against the hospital. If a BPP had, in fact, been done, or could even be reconstructed and seen to be reassuring on a videotape by me or another expert, then the hospital and sonographer and probably the referring docs would have been cleared.

Other lessons:

Get orders in writing. A chain of written orders would probably have saved this baby. Do what is indicated, even if not asked for... An OB sonogram without BPP is not the follow-up for a nonreactive NST. Check an MCA V-Max (with angle correction) if the complaint is the cessation of fetal movement. An increase indicates a fetal anemia you may not pick up in other ways until the suituation is extreme.

Like I said before, the content of the examination - as are the content of all medical records- is/are the PROPERTY of the patient.

I personally would never go along with any loved one from my family who went somewhere for an OB sonogram where they did not let her have a tape or disc of the exam. What are they hiding??!!

I wonder about the requirement that a regular physician-ordered ultrasound has to be done first. Does this mean that patient could have two ultrasounds in one day, perhaps performed by the same sonographer. I would think the insurance/Medicare/other third party payer would wonder why they have to pay for an exam that the patient is paying for out of her pocket just a few

minutes later.
