I will have to look again but there are States that don't allow the patient to have any kind of open access to medical records. The way this law was written it said that they could not have actual copies of the medical record regardless of the reason.

I will have to find the exact law on this b/c when I read it I was shocked that such a thing still existed. And TX is another one that doesn't allow a patient to have actual copies of the records but if they needed to move and the new dr needed info from that record then they could have a summary and that's what they got. I have lived both in TX and OR and when we moved from there my mother didn't get copies of actual medical records but just a letter that summarized their medical history.

Also, I think that an office or clinic can refuse to give you copies of your medical records b/c a girl in TX asked if she could have a copy of her records and they said no.

That's why when someone has a question about medical records as far as the laws in their State I tell them to talk to the Medical Records Assocation in their home State.

Let me find the exact law for you so that you can see what I'm talking about. But like I said when I read it I was shocked b/c here in FL not only can you see your records if you want to (my dr lets me view my labs like when cultures are done, lab reports) but that you can actually request the copies of medical records.

I just couldn't believe that there were actually States that said that you couldn't have actual copies of medical records regardless of what the reason, but for the States where it is allowable they can charge. One girl asked for copies of her medical records and the dr's office said that they wouldn't let her have the copies until she paid a bill for a visit she made to the dr, and then that the charge for the copied records was like $50.

I agree that everyone should have access to their records regardless of the reason or situation.

And that's why I was saying that if you got copies of the actual medical record they must have changed the law recently and if that's the case that's good.
