I like the following definition: "Infertility is the inability to achieve preganncy after one year of adequate sexual exposure, or repeated failure to carry a pregnancy to term." (vd Merwe in Clinical Gynaecology: Odendaal, Schaetzing and Kruger.)

So she is indeed infertile, but secondary. What does the insurance company's rule book say? Or are they making this up as they go along?

ICD 9 is not a suitable document to define such issues in my view.
