In other words, while nonpregnant, she may have been okay - not a threat. But she WAS apparently a threat to her children, I suspect more by neglect rather than active harm. So now that she's pregnant, is there a case to be made for "fetal neglect" that might need to be addressed by the authorities? The fact that she refuses prenatal care type testing gives you some hint...

If I remember correctly, by Texas law the fetus is not a person and has no rights until it is born.
