hi! the reason HMO's have thus far escaped respoonsibility for their actions is the ERISA statute. basically, this is a federal law which covers employee benefits including health insurance. should an action ensue, the insurance company always has been able to opt out into federal court, leaving the malpractice arena to the doc! The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
