Technically, I would think a doctor-and-patient relationship was established. On the other hand, when the doctor is not on call for the ER, I don't think he has an obligation to go in just to see her. After all, the patient went to the ER and should expect to be treated by the ER staff on duty. If the patient had called the doctor office directly, then I would think that the doctor has an obligation to see her. That's just my opinion. The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
