Doctors Who Testify as Experts for Med-Mal Plaintiffs Can Sue if Peers Discipline Them

In the first decision on the issue by a Florida appellate court and possibly by any court in the country, a panel in Tallahassee has ruled that the Florida Medical Association and three doctors are not immune from liability in connection with efforts to discipline a doctor who testified as a plaintiff expert in a malpractice case. The ruling is the latest setback for medical societies that have targeted plaintiff experts in an attempt to clamp down on what they consider fraudulent and abusive testimony.

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
