Hospital and Insurer Sue La. Hospital; Get $4 Million Jury Verdict A Washington hospital and medical malpractice insurer successfully sued a Louisiana hospital and two doctors who wrote letters of recommendation for another doctor without disclosing his drug problem. This is said to be the first time a hospital sues another over failing to disclose adverse information about a doctor being considered for privileges to practice. Western Professional Insurance and Kadlec Medical Center sued Lakeview Regional Medical Center and two physicians who wrote "glowing" letters of recommendation for Dr. Robert Lee Berry and did not tell of his history of drug use. Lakeview hospital and Lakeview Anesthesia Associates asked Berry to leave but technically did not fire him, thus avoiding having to report any action to the national physician databank.. The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
