Re: Informed consent --> legal smeagolFrom: Ina May Gaskin (inamaygaskin@gmail.com)Wed Jun 7 07:55:10 2006
<Remember that the U.S. legal "system" is the product of Europe, America (e.g. allegedly the Iroquis Indian model, in some instances) and miscellaneous other concepts put together as an as-yet-unequaled system of justice.> I am sure that the Iroquois (Hau de no sau nee) would not agree that their system of government was the source for the concept of the lawsuit. They never had anything remotely like the McDonalds lawsuit. Let's remember that the whole idea of malpractice lawsuit was created by the people who didn't want there to be health insurance for all citizens here. That left a vacuum for the creation of a solution in situations when one of the uninsured is injured by medical error and can't afford the care required by their condition. The rest grew like cancer. Is it US-bashing to point out how silly the McDonald's lawsuit was? Naw. As big and influential as the US is (often in bad ideas), we from the US could have thicker skins when our country's ways of doing things are criticized, I think. Ina May

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education. OBGYN.net believes these interaction in this forum meets these criteria. For further information see the AMA web site.
