So why not put the embryos up for adoption? Several reasons

1. Personal choice. Most people do not want their genetic material floating out there not under their control

2. Little to no screening of the recipients. Bad things happen even when couples are screened for routine adoption. With embryo adoption there is no formal system of screening recipients beyond FDA required testing and the clinics own rules (if any). I contacted the people in the state of Florida who are responsible for adoption screening. They had no interest in adding to their work load by accepting the responsibility of screening recipients. When couples are informed that there is no formal screening they do not want to donate. If governments want to decrease the number of embryos discarded they needed to do what is right and agree and mandate formal adoption screening of recipients. After all the ethical argument is that these are potential children. Why should they not be protected under adoption law?

As far as laws blocking destruction, this is already on the books in Louisiana. Therefore, after freezing the embryos, they ship them to Houston for storage. Texas doesn't restrict what a couple can do with their embryos.
