Not every jurisdiction is the same, but from classic tort law, "mental
anguish" has to be almost incapacitating. Simply putting in a few hours at
the rapist isn't going to cut it. So in anticipation of the big class
action, anyone wanting to participate should "take off" work a few days to
get treatment - then point to the severity of the mental anguish (e.g. loss
of work, loss of income, etc.) as one element of your case.

I think that you are on to something. Now, we have all the anguish about all
the patients out there that have previously or continue to use this patch.
The trauma, the agony, the years of therapy.
