I disagree -- if it was an emergency C/S with unkown final status of the baby then not doing the TL is reasonable care. Was she the primary Ob provider for the patient (ie - was she the one who had the discussions when the patient was not in labor or in the emergency)? If she was and knew the patient wanted the TL and did not discuss it with her at the time as to why she was not doing it then there may be a case. However if the patient rolled in with a prolapsed cord and the ontire care had the sinuglar focus on getting the baby out pronto - then there may not have been a chance to have that discussion and then also not knowing what the outcome would be for the baby -- it is always best (in my judgement as well as how I was trained) to err on the side of doing the sterilization later. The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
