Congress Approves Moving Class Action Suits to Federal Court

The Associated Press

In a 279-149 vote, the House on Thursday passed legislation that would transfer most large, multistate class action lawsuits to federal court, fulfilling one of President Bush's second-term goals. The aim of the bill was to protect businesses and stop lawyers from reaping huge profits by filing suits in carefully selected state courts. Bush is expected to sign the bill into law today.

3rd Circuit Upholds Dismissal of Class Action Against Salomon Smith Barney

Taking a broad reading of the Securities Litigation Uniform Standards Act, a unanimous 3rd Circuit panel has upheld the removal and dismissal of a state court class action suit against Salomon Smith Barney brought by brokerage customers who claimed they were given biased investment research. The appeals court found that although the suit sounded only in state law claims, the allegations related to the purchase or sale of securities and were therefore pre-empted by SLUSA.
