AAMC requests safe harbor to support electronic health record keeping

The AAMC, along with several other institutions and organizations, has asked the Department of Health and Human Services Office of Inspector General (OIG) to create a safe harbor to protect the support that hospitals, health systems, and multi-specialty group practices provide to affiliated physicians for dissemination and maintenance of electronic health records. The AAMC's letter was submitted to the federal government in response to OIG's annual request for safe harbor suggestions. The Bush administration has announced its strong support for the development of integrated health information systems, and the electronic health record will be a central component. Many have recognized that the physician self-referral prohibition and the anti-kickback statute may be barriers to such development. The AAMC's request to OIG establishes a strong case for safe harbor protection and suggests ways to craft the safe harbor to promote the administration's goals while avoiding violations of the fraud and abuse laws.

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
