I think the chief of both departments need to get together ands talk on what is appropriate. We have a perinatal committed at our hospital where the Chief of the NICU and the Obstetrician in chief comes to discuss transfers and any other problems, so that they may be resolved amicably on both sides.

According to EMTELA the sending facility is the one at risk, they have to decide if the patient is stable enough to be transferred.

If we need to section a patient under 32 weeks we always call for the transport team prior to delivery, since it takes up to an hour for them to arrive.

A CNM partner of mine had a patient last week at 28 weeks gestation who presented with a cc of decreased FM for 2 days. FHR tracing was flat and BPP was 2/10. The obstetrician wanted to transfer her to our referring facility (15 min. away) by air.

The perinatologist advised an immediate C/S but refused to accept the patient saying they would not take the legal risk of a fetal demise enroute. As our facility started getting ready for a C/S, our nursury and pediatrician called the referring neonatal facility. In the past the team had come to be present for the C/S and take charge of the NB immediately. They also refused, saying the NB should be delivered, initial care given, and then the transport team called.

Isnn't this malpractice situation great for the best patient care?
