This is not a happy story. A referendum was passed by the electorate last year supporting a statute much like California malpractice law. It must be passed one more time by the electorate before it can become law. One of the insurers just yesterday requested a 10.6% raise in premiums this go round. Requests for increases from other insurers as policies need renewal are likely. The number of malpractice cases filed in Clark County (Las Vegas) has significantly increased after the last emergency session of the legislature discontinued the Malpractice Screening Panel that was a disincentive for frivolous suits while putting caps on awards with so many exceptions as to make them worthless. Insurance premiums are only one of three negative influences on the practice of medicine. Factor in the reduced reimbursement from managed care and federalization in the form of HIPPA, OSHA, ADA, and CLIA and we are coming ever close to going over the edge. The model of medical practice as we have known it, is no longer viable. In view of the tragic story of one of our posters a few days ago, it would be wise for all to have an exit strategy. Right now docs are moving to venues with more favorable tort laws. How many refugees these "Warsaw ghettos" (no offense meant, it's just an appropriate metaphor) can handle is unknown. Exit strategy. The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
