Well, that's why God made summary judgment. You try to KEEP IT FROM the jury.

But most of these cases are pretty fact intensive, and one of the main jobs of the lawyers is to gather the facts and put the story together to show what happened. THEN you get your medical expert to give the opinion, based on the facts of the particular case in the backdrop of known medical knowledge, whether the bad outcome is CAUSED BY anything the doctor did or didn't do that was beneath the standard of care.

As I say, you need a good lawyer, WITH THE HELP OF HIS CLIENT.

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
