You can bill e/m codes based on time if >50% of time spent face to face with patient involves counseling. This is standard coding stuff. However, as was noted, billing e/m codes for phone calls would be fraudulent as there is no face to face time. Hmmm... wonder about those video phones? :)

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
