The data protection issues would be identical to those governing patient information residing on a desktop computer, on a paper record, or on an in-office server.

If the rules stand (and they won't be enforced for two years), each office would need to develop P & P regarding the secure storage and access of patient information, wherever it resides.

Additionally, digital patient information must be protected to allow only those with a "need to know" have access to it (at least a username and password) and the information must be safe from prying eyes (e.g. encryption, so that the night janitors cannot turn on the computer and "browse" patient information files).

With that being said, since a handheld is usually in one's personal possession, and might even be password protected (to prevent other personal information from being viewed like private phone numbers), I don't think anybody is going to go after docs who have the vision to carry relatively exposed patient information with them so they can deliver better care to those same patients.
