Don't forget the 14th amendment. It gives Congress the right to legislate. Article 5 reads: "Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article" see: <http://www.law.cornell.edu/constitution/constitution.amendmentxiv.html>.

Specifically referring to contraception, read Griswold v. Connecticut, 381 U.S. 479 (1965)

No, it isn't. Congress can only do the specific list of things that the Constitution says it can do. (See the tenth amendment.) Contraceptive coverage ain't on that list, last time I looked.

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
