Our presentation and discussion with HCFA went reasonably well, although no decision was made during the meeting. Terry Kay did note at the conclusion of the meeting that a decision could be expected very shortly. (1) Leave the Final Rules as they are (requiring direct or personal supervision, depending on CPT code). (2) Alter some of the codes based on the comments they have received. (3) Delay implementation until a group can be convened to arrive at a concensus. Of course, some combination of these is possible, as is simply sending the issue back to the carrier level. For those of you that would like me to look into a crystal ball (and, subsequently eat ground glass), I'll provide my best guess. Although I do not believe that it is the option that the HCFA representatives would most prefer, I suspect that they will opt for a delay. If this doesn't occur, the second most likely option (in my opinion) would be that most, although probably not all, of the codes currently requiring direct supervision will be changed to general supervision. I believe that it is unlikely that the Final Rule will remain unchanged. Represented at the meeting were: American Academy of Neurology, American Society of Neuroimaging, SVT, SDMS, NEMA and an IPL representative. AIUM was unable to attend. SVS/ISCVS & SVT had a previous meeting with HCFA. The meeting was coordinated by Bill Sarraille & Alan Reider of Arent Fox (SVT's Counsel). The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
