Actually, this is not entirely correct- it depends on what state you live in. There are some states which have a process to weed out frivolous claims-many do not. Legal expenses do comprise a large part of malpractice premium- about 60%. You also have not considered that with liability insurance the duty to defend is greater than the duty to pay.
