Dona and Chris,

Not every state allows the patient to have copies of their medical records even when the patient makes a request for the copies. TX and OR are two such States that will not allow the patient to have actual copies of the medical record. They will however let the patient have a summary of the medical record but that is it. States like FL on the other hand have allowed for the patient to have direct access to their medical records. Also, each time I've asked for my medical records from my drs here they have given them to me. One time when I went to see a Pain Management dr for something and I had to get the records from the dr originally treating the problem I was able to get a copy of the medical records and I gave it to the dr myself. His office didn't call over to the referring physician to get the records.

The best way to find out what the law is in each State when it comes to Medical Records is to get in touch with the local Medical Records Association in your Home State. You do so by finding the information at: http://www.ahima.org.
