I got this email from someone today and would like any and all comments that will be kept absolutely private by me (since I am not a physician, I feel I cannot properly opine on her questions: ========================================================================= I had a vaginal delivery of my daughter on 10/13/06. The delivery was rough and resulted in a 4th degree tear. Two days after being discharged I was readmitted with a baseball size rectal impaction. The impaction broke down the repair and it was discovered that I had a rectovaginal fistula and my internal anal sphincter was "blown out". I spent 6 months in diapers and fighting infections. I had a sphinteroplasty on 4/16/07. I am now at 80% control of my bowels and according to the colo-rectal surgeon, that is the best I am going to get. Now, to why I feel I have a malpractice case. I have a long history of IBS with chronic constipation. This condition was noted in my chart, yet not considered when I was initially discharged. I know it was not considered because the OB who delivered my baby and discharged me dictated that he had no knowledge of this. He also stated it was not in my medical record. I have a complete copy of my medical record and it is plainly noted. I contacted a lawyer in May. He had an OB/GYN review my files. He found there to be no malpractice. I'm baffled! Is there anything you can do to help me? I will take any info or advice you can offer. Is there truly no case here? I realize you don't have all the details or my records to review, so it would be hard for you to determine matter of factly. The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
