I recently testified in a Federal Tort Case (shoulder dystocia). The case occurred on a military base. It settled for $600,000. So I do not understand the cap you mention. As I understand the Federal rule, Federal employees can be sued in civilian court, including Military MD's. However most lawyers automatically go for Federal court in that Federal employees do not buy personal insurance, thus have very little in their bank accts. It is my understanding that nothing precludes a civilian suit. However the Feds usually step in and agree to accept suit, thus stopping the civilian action. I do know a Federally funded clinic in Mount Olive NC did have the Feds cover a grievous malpractice action involving a missed and mishandled (both) breast ca. I do not know the final settlement but it is my understanding it was greater than $ 500,000.
