the way this reads, the "consultants" in India aren't testifying - rather, they're IM'ing counsel suggesting lines of questioning to undermine the witness. Unless regulations are updated to prevent IM'ing in the courtroom, crackberry's, smart phones, etc, there's not much a judge can do about this is there?

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
