Simply following Pastorek's Law. New Report Shows Med Mal Insurers Price-Gouging Doctors A report issued by the American Association for Justice (AAJ) shows the medical malpractice insurance industry price-gouged doctors with excessive premiums and contributed to the increased cost of healthcare. Written by former Missouri Insurance Commissioner Jay Angoff, the study is based on annual reports from the top 15 medical malpractice insurers as rated by A.M. Best. The study shows: insurers' losses and projected losses fell 48 percent from 2003-2006; losses declined every year for the past five years; surplus is five times the required surplus for insurer stability; only three of the 15 leading insurers gave dividends to doctors in 2006. AAJ calls for an immediate review of the insurance industry's tactics. The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
