Well, perhaps. Perhaps he also just didn't have a "good" jury. The system seems such a travesty. Anyone recall the juror on the (was it sixty mins or some such show) case detailing the long process of bad baby trial which profiled in such detail the defendant, her group, her defense, etc? The juror's comment was basically that it was recognized (by at least some) that the doctor had done everything she was supposed to, could do, but the jury felt the infant needed aassistance and so they made their judgment. Anyone remember when the Wash DC verdict went against Bendectin. Afterward the plaintiff's atty stated let the word go forth that Bendectin is a teratogen. Not because some scientific study said so, but because a jury in Wash DC said so. (Now, I'm always been willing to bet the head of the FDA, no university toxicologist, no embryologist .. nor any sec of state or retired atty or judge was on that jury. Rather, just an average collection of our peers for jury duty who wouldn't couldn't avoid the duty.) Don't we need something medically akin to maritime lawyer and maritime courts to bring sense to the sytem...and to make it better for all concerned, including plaintiffs, many of whom do not get what they deserve, IMHO, despite the publicity gathering outrageous cases often gather at the expense of the more mundane. And of course, we physicians need to encourage a professional and public/patient public awareness/education campaign awareness that this system is so often a joke. Maybe we should all post large notices in our waiting rooms that we know lots of md's who've been sued, and some of whom who have lost their cases, but given the bogus system this country has, we stand proudly by most of them as only a tiny fraction are the negative performers the plaintiff atty's pictured them as.

Well, I do ramble...I don't have the er call and it must be time to listen to some Pat Metheny or Kenny Burrell while pondering the mysteries of fine aged sherry.

Well, I'd argue "Pastorek's Law" again and opine that the poor guy didn't have a good lawyer. Which is often the case.
