JCAHO does not have any legal authority over anyone. It is a voluntary organization that hospitals use to accredit themselves as a demonstration of quality care. Witholding JCAHO's blessing can however, affect contracting issues and lack of accreditation or withdrawing of accreditation implies a lesser quality of care and lack of oversight of care. In California, the only entity that has legal authority over hospitals is DHS (Department of Health Services) and usually they review us at the same time as JCAHO. Sometimes their requirements and JCAHO's requirements are in conflict, and we have to meet the stricter requirement. The informed consent requirement is not just JCAHO's, but also DHS's.

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
