But since when does the medical logic guide the judicial system? Witness CP and birth injury...

All a lawyer needs to win a case is to demonstrate that there is a relatively increased risk of VTE, and parade the patient with neurologic deficit resultant from such an event, and you have lost.

Unfortunate condition of our system.
