Legally and ethically it is not an option. It's not like us calling a general surgeon in to take care of a hot appendix we find at the time of a diagnostic laparoscopy to R/O PID. He may think it's the same, but he needs to be educated and know that our hands are tied by federal law. If its not an emergency chole and he can postpone it, you could see the patient, counsel her, have her sign the consent then do it in 72 hours if she is a private patient; if she is Medicaid, you have to wait at least 30 days - at least that is true in California. The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
