Same with bakers, tailors and candlestick makers. True, some physicians exploit the system, but they did not create the system. I have been very active in Florida on tort reform and several weeks ago I had a very interesting discussion with a legislative aide. He outlined the problem very succinctly. The problem are the physicians themselves!!!! Trial attorneys cannot win cases on their own, they rely on medical experts. We physicians will testify against another physician for a price. We advertise on their legal journals! Physicians make a great living on expert testimony and reviwing charts! Rarely will you EVER find an attorney to testify against another attorney. His solution was not to place a cap on non economic damages, place a cap on how much an expert can make from a medical malpractice case. If we placed a cap of $300 of expert testimony, you will see a SIGNIFICANT drop in Med Mal cases! What a very interesting idea......... The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
