Excerpted from the latest ACOG Red Alert: "Both Kerry and Edwards are attorneys, and both have in their previous careers represented plaintiffs in medical liability cases. Many of Edwards' malpractice cases were directed at physicians, winning close to an estimated $60 million in verdicts against ob-gyns. Kerry and Edwards voted against MICRA-like medical liability reform in the U.S. Senate this past year, indicating instead that they would support: A requirement that medical malpractice claims first go before a qualified medical specialist to determine whether a reasonable grievance exists. A requirement that states ensure the availability of non-binding mediation in all malpractice claims before cases proceed to trial. Support for sanctions against plaintiffs and lawyers who bring frivolous medical malpractice claims, including a "three strikes and you're out" provision preventing lawyers who file three frivolous cases from bringing another suit for 10 years. Opposing punitive damages -- unless intentional misconduct, gross negligence, or reckless indifference to life can be established. Eliminating special privileges that allow insurance companies to fix prices and collude in ways that increase medical malpractice premiums." ?????????????????????????????????????????????????????????????! The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
