Federal Judge Ices Ban on 'Partial-Birth' Abortion

Finding government witnesses lacking in credibility, federal Judge Phyllis Hamilton on Tuesday declared unconstitutional the 2003 Partial Birth Abortion Ban Act, taking the side of Planned Parenthood Federation of America, which had challenged Attorney General John Ashcroft's enforcement of the act. Lawyers in the case say the ruling's exhaustiveness should help shield Hamilton from claims that she is an "activist" judge who based her decision on political beliefs.
