In the wsj article - the real news was NOT the patientsd' waiver but the existence of a group called "Medical Justice" based in Greensboro, NC.

"Medical Justice, which has about 500 members in 30 states, covers expenses for countersuits if a case against a doctor is deemed frivolous. If a doctor member is sued, Medical Justice will send a letter to the patient's lawyer warning that the doctor will sue back if the original suit is judged to be without merit. The plan's costs range from $625 to $1,800 a year, depending on medical specialty and location.

Medical Justice also promises to go after expert medical witnesses that have committed perjury or delivered false testimony during legal proceedings. The plan will research the expert's testimony and, if necessary, demand investigation by state licensing boards and medical societies."

The American Medical Association is no longer designating CME hours for AMA Category II CME credit. However, physicians themselves may self designate learning activities as Category II CME credit hours if they feel it is of sufficient educational merit and meets the formal definitions of continuing medical education.
