It is pretty incredible that there exists an OB anywhere in this day and age who wouldn't get a cord Ph on an unresponsive newborn. That said, it is equally incredible that compensation for a catastrophically damaged newborn would depend upon a blood gas report. I thought the no-fault fund was designed to take care of any neurologically damaged newborn without the need to go through any process at all. Who really cares whether the injury was caused by hypoxia or some poorly defined antenatal event? The mere existence of a brain damaged newborn should qualify the patient for compensation. I thought that was the whole idea behind this concept.
