Hi everyone!!

I have a question for all of you especially for other FL residents.

Before I ask my question let me tell you what's going on now (forgive me for repeating this but I want to make sure that everyone gets this).

I got to talking to my ins co about the out of network situation if I could not find a dr in network to take care of a situation: in this case the Pain Management dr. Thru talking to the rep I found out that they got the ok for the referral but I was never told by the referral clerk at my dr's office that they got it.

After I finished talking to the rep at my ins co I talked to the receptionist at the Pain Management dr's office who then said that the information was faxed over. When she said information I knew that my medical record was most likely included along with that referral. I asked the receptionist to read what the diagnosis stated and it said: "chronic pelvic pain" (which I told my dr I had strong feelings was related to the endometriosis) and "vulvodynia" (told her last year that Pain Management wasn't an option for this, plus I can handle it by myself-yes I have to have the narcotic for the flare ups when they get so bad, so bad that I'm disabled without the narcotic and anti-inflammatory drug combination that keeps me functioning during those times).

Also this Pain Management dr that my dr wants me to see has already said that she can't help me. Her knowledge about endo is very limited. The only thing she knows is that it can be misdiagnosed. And as for the vulvodynia she knows squat.

All right now here's my question. Is it legal for one dr to fax or send medical records to another dr without the patient's being told about it? Also, does anyone know what is meant by "continuing care" and how that applies to what I was told is a very thin line when it comes to giving out medical records?

My understanding of this is that when it comes to the medical records of a patient going from one dr to another even for referral purposes that a release form must be signed before those records can be copied for another dr to see. And the reason that I say this is b/c that's what I had to do the last time I went to Pain Management (for an unrelated problem).

I did however fax over my medical history of the last 5 years as well as a letter to the Pain Management dr herself explaining what I need and what I want.

I will let everyone know how that goes.
